GOVERNMENT OF MIZORAM

N O T I F I C A T I O N

Dated Aizawl, the 20^th June 2001.

Whereas it is expedient to amend the Rules for Registration of Contractor under Public Works Department owing to reorganisation of the Department and others, the Governor of Mizoram hereby makes the following Rules:-

Short Title and Commencement 1.

(1)       These Rules may be called the Mizoram (Registration of Contractors) Third Amendment) Rules 2001.

(2)         They shall come into force from the date of publication in the Official Gazette.

Amendment of Rule 4.

2. In the Rules for Registration of Contractor under Public Works Department, Mizoram – 1998 (hereinafter referred to the Principal Rules) for Rule 4, the following Rules shall be substituted:-

4. REGISTERING AUTHORITY

(1)         Registration of Class-I Contractor shall be done by the Engineer-in-Chief, Public Works Department with approval of a Committee consisting of the Secretary, Public Works Department as a Chairman, Chief Engineer, Public Works Department Zone-I, Chief Engineer, Public Works Department Zone-II and all Superintending Engineers under Public Works Department as Members.

(2)         Registration of Class-II Contractor shall be done by the Chief Engineers, Public Works Department Zones-I and II for their respective Zones with the approval of a Committee consisting of the Engineer-in-Chief, Public Works Department as a Chairman and all Superintending Engineers under Public Works Department as Members.

(3)         Registration of Class-III Contractor shall be done by the designated Superintending Engineers under Public Works Department with the approval of a Committee consisting the Chief Engineer, Public Works Department of the concerned Zone as the Chairman and all the Superintending Engineers under Public Works Department of the concerned Zone as Members.

(4)         Registration of Class-IV Contractor shall be done by the Executive Engineer concerned with the approval of a Committee consisting of the concerned Executive Engineers under Public Works Department.  Working Division of same Circle and all Sub-Divisional Officers of the Division concerned as Members.”

Amendment of Rule 5. 3. In the principal Rules for Rule 5, the following Rules shall be substituted:-

5. QUALIFICATIONS:

(1)         CLASS-I.  A Contractor desiring registration as Class-I Contractor –

a)      should have sufficient means, organization and machinery for executing the works;

c)      should have at least 5 years’ experience as a registered Class-II Contractor.  Provided that Graduate Engineer with 10 years experience and Diploma Engineer with 20 years experience who had retired as Executive Engineer and above shall be eligible to registration as Class-I Contractor.

(2)     CLASS-II.  A Contractor desiring registration as Class-II Contractor –

a)    should have satisfactorily executed at least three works of not less than Rs 5.00 lakhs each, at least one of which has been of Building works and the aggregate value of all such works executed has not been less than Rs 10.00 lakhs during last five years from the date of his application.

b)   should have at least five years’ experience as a registered Class-III Contractor:

Provided that Graduate Engineer with three years experience and Diploma Engineer with ten years experience and having retired as Assistant Engineer or Sub-Divisional Officer and above shall be eligible to registration as Class-II Contractor.

3)   CLASS-III.   A Contractor desiring registration as Class-III Contractor –

a)   should have satisfactorily executed works, the aggregate value of which is not less than Rs 3.00 lakhs

b)   Should have at least three years’ experience as a Registered Class-IV Contractor:

Provided that Graduate Engineer even without experience, Diploma Engineer with three years experience and non-Diploma Engineer with ten years experience shall be eligible to registration as Class-III Contractor.

4)   CLASS IV.   Any person/individual desiring a registration as Class-IV Contractor should have a permanent residence in Mizoram.  He should produce a House Tax Clearance Certificate indicating the House Pass or Land Settlement Certificate No. and year at the time of submitting his application for registration.  In the case of the person/individual having only House site allotted by Revenue Department/Village Council Authority concerned, the certificate and Xerox copy of the House Site duly countersigned by the President of the Village Council concerned or by the Officer of the Revenue Department, as the case may be”.  

AMENDMENT OF : In the principal Rules, for the table under Rule 6, the following

RULE 6           table shall be substituted, namely:-

Insertion of New Rule 4. In the principal Rule after Rule 5, a new Rule 5-A shall be inserted as follows:-

5-A. AREA OF OPERATION:

(1)         The area of operation of Class-I and Class-II Contractors shall be all Mizoram.

(2)        The area of operation of Class-III Contractors shall be divided into two namely, Southern and Northern.  Class-III Contractors registered by Superintending Engineer, Lunglei Circle shall operate within Lunglei and undivided district of Chhimtuipui and those registered by other Circles shall operate within the undivided Aizawl District.

(3)        The area of operation for Class-IV Contractors shall be confined within the Circle under which registration was made”.
